Agreement
These Terms of Service ("Terms") are an agreement between you and 5th Ocean Studio Private Limited ("5th Ocean Studios", "we", "us") for your use of Ilavath: Battle of Cosmos ("the game") on any device, and ilavath.com. By downloading, installing or playing the game, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the game.
If you downloaded the game from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies, and the Apple-specific terms in section 13 apply.
Who can play
You must be at least 13 years old, or the minimum age required in your country to agree to these Terms, to play. If you are under the age of majority where you live, your parent or guardian must agree to these Terms for you and is responsible for your purchases.
Your licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the game for your own non-commercial entertainment, on devices you own or control, subject to these Terms and the rules of the store you downloaded it from.
You may not copy, modify, reverse engineer, decompile, sell, rent or distribute the game or any part of it, except where the law expressly allows this.
Accounts and sign-in
You can play as a guest. You can also choose to sign in with Google, Apple, Facebook, Google Play Games or Apple Game Center to save progress across devices. You are responsible for keeping access to that sign-in secure. Guest progress is stored on your device and may be lost if you uninstall the game or change devices without signing in.
Virtual items and currency
The game includes virtual items and currency, such as Soul Fragments and Kalash chests (Tamra, Rajat, Swarna, Ratna, Akshaya and Vijay Trove), which you can earn in play or buy with real money.
- Virtual items and currency are licensed to you, not sold. They have no real-world monetary value, cannot be exchanged for real money, goods or services outside the game, and cannot be transferred or sold to anyone else.
- Kalash chests contain randomised rewards. The drop rates for each chest are shown in the game before you buy or open it.
- We may change, rebalance or remove virtual items as the game develops, but we will not remove an item you bought within 30 days of purchase without offering a replacement or refund.
- If the game is shut down, we will give at least 60 days' notice in the game, and stop selling virtual items when we give that notice.
Purchases and refunds
All in-app purchases are processed by Google Play or the Apple App Store, under their terms. Prices are shown in the store before you buy and include any taxes the store applies.
All purchases are final once the item is delivered to your account, except where the store's refund policy or the law where you live gives you a right to a refund. To request a refund, use the store you bought from:
- Google Play: Google Play refund policies
- App Store: Request a refund from Apple
If an item you paid for did not arrive, email us with your transaction ID and in-game User ID and we will fix it.
EEA and UK consumers: when you buy digital content that is delivered immediately, you agree to immediate delivery and acknowledge that you lose your 14-day right of withdrawal once delivery starts.
Ads
The game shows rewarded ads only when you choose to watch one, in exchange for an in-game reward. If an ad fails to load or complete, the reward may not be given. Ad content comes from third parties, and we are not responsible for advertisers' products or websites.
Fair play
You agree not to:
- use cheats, bots, hacks, modified clients or any software that changes or automates gameplay;
- exploit bugs or glitches (please report them to us instead);
- buy, sell or trade accounts or virtual items outside the game;
- interfere with the game's servers, ads or purchase systems, or attempt unauthorised access;
- use the game for any unlawful purpose.
If you break these rules, we may remove virtual items gained unfairly, suspend or close your account, or stop you from using the game. Where reasonable, we will tell you why and give you a chance to respond.
Intellectual property
The game, including its code, characters, artwork, music, names and logos (including "Ilavath" and "Ilavath: Battle of Cosmos"), is owned by or licensed to 5th Ocean Studio Private Limited and protected by intellectual-property laws. These Terms do not give you any ownership rights in the game.
You may share screenshots and videos of your own gameplay for non-commercial purposes, including on streaming and video platforms that pay creators, as long as you do not suggest our endorsement.
If you send us ideas or feedback, we may use them without any obligation to you.
Updates and availability
We may update, change or discontinue features of the game. Some updates may be required to keep playing. The game may be unavailable from time to time for maintenance or reasons outside our control. Features may differ between countries and devices.
Disclaimers and liability
The game is provided "as is" and "as available". To the fullest extent the law allows, we do not guarantee that it will be uninterrupted or error-free.
To the fullest extent the law allows, 5th Ocean Studio Private Limited will not be liable for indirect, incidental or consequential losses, or for loss of data or virtual items caused by events outside our reasonable control. Our total liability to you for any claim related to the game is limited to the amount you paid us in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence or for fraud, or your statutory rights as a consumer.
Apple App Store terms
If you downloaded the game from the App Store: these Terms are between you and 5th Ocean Studio Private Limited, not Apple. Apple has no obligation to provide maintenance or support for the game. If the game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the game, including product liability, legal or regulatory compliance, or consumer protection claims, or for investigating any claim that the game infringes third-party intellectual property. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Ending these Terms
You can stop playing at any time by uninstalling the game and, if you signed in, asking us to delete your account. We may suspend or end your access if you seriously or repeatedly breach these Terms. Sections on virtual items, intellectual property, liability and governing law continue after these Terms end.
Governing law and disputes
These Terms are governed by the laws of India. Before going to court, please contact us so we can try to resolve the issue informally within 30 days. Courts in Hyderabad, Telangana, have jurisdiction over disputes, except that if you are a consumer in the EEA, UK or another country whose law gives you the right to bring proceedings in your local courts, you may do so, and the mandatory consumer laws of your country continue to apply.
Changes to these Terms
We may update these Terms. We will post the new version here with a new date and, for significant changes, tell you in the game at least 15 days before they take effect. If you keep playing after that, the new Terms apply.
